Terms of Service
Review the general terms governing the Surge Now, Pay Later website, RV Surge platform, accounts, and services.
These Terms of Service and User Agreement (“Terms”) form a binding agreement between you and Local Lead Hub LLC, doing business as RV Surge™.
In these Terms:
- “RV Surge,” “we,” “us,” and “our” mean Local Lead Hub LLC, doing business as RV Surge.
- “You,” “your,” “Customer,” “Client,” “Participant,” and “User” mean the individual or business accessing or using the Services.
- “Authorized User” means an employee, contractor, agent, or other individual whom you authorize to access your account.
- “Services” means the websites, software, systems, subscriptions, communications tools, artificial intelligence tools, marketing services, educational resources, communities, and other products or services made available by RV Surge.
- “Sites” means SurgeNowPayLater.com, rvsurge.com, portal.rvsurge.com, and any other website or online property operated by or on behalf of RV Surge.
- “Order” means an enrollment confirmation, checkout page, service order, proposal, invoice, subscription selection, signed agreement, or other document describing the Services you purchase.
- “Customer Data” means information, content, records, files, contacts, messages, and other materials submitted to or processed through your account.
Surge Now, Pay Later™ is a program from RV Surge™. RV Surge™ is operated by Local Lead Hub LLC.
By accessing a Site, creating an account, checking an acceptance box, electronically signing an agreement, submitting payment, or using any Service, you acknowledge that you have read, understood, and agreed to these Terms.
If you do not agree to these Terms, do not access or use the Services.
1. Eligibility and Authority
You must be at least eighteen years old to create an account, purchase Services, or enter into an agreement with RV Surge.
If you use the Services on behalf of a company, organization, partnership, or other legal entity, you represent that:
- You have authority to bind that entity;
- The information you provide is accurate and complete;
- The entity agrees to these Terms; and
- You are responsible for the entity’s compliance with these Terms.
You may not use the Services if you are prohibited from doing so under applicable law.
2. Scope of the Services
Depending on your plan, Order, configuration, eligibility, and available features, RV Surge may provide access to services such as:
- Customer relationship management tools;
- Contact and customer records;
- Unified conversations and inbox tools;
- Business phone numbers;
- Call tracking and call routing;
- Missed-call text-back;
- Text messaging;
- Email messaging and marketing;
- Calendars and online booking;
- Forms and surveys;
- Opportunities and sales pipelines;
- Estimates, invoices, documents, and agreements;
- Payment-collection tools;
- Websites, landing pages, and forms;
- Reviews and reputation-management tools;
- Social-media tools;
- Blogging and content tools;
- Marketing automation and workflows;
- Reporting and attribution;
- Google and Meta advertising tools;
- Harvey Voice;
- Harvey Chat;
- Artificial intelligence assistants and content tools;
- Communities and member portals;
- Educational webinars;
- Office Hours;
- Group onboarding;
- Launch guides, trackers, templates, and resources;
- Managed marketing or implementation services; and
- Other related products or services.
Not every Service or feature is included with every plan.
The exact Services included with your account are determined by your Order, plan, enrollment confirmation, and any additional written terms.
3. Additional and Program-Specific Terms
Certain Services may be governed by additional terms.
Additional terms may include:
- Surge Now, Pay Later™ Program Terms;
- Surge Now, Pay Later™ Refund Policy;
- Privacy Policy;
- Anti-Spam Policy;
- Enrollment agreements;
- Service orders;
- Advertising agreements;
- Managed-services agreements;
- Payment-processing terms;
- Community rules; and
- Third-party provider terms.
Those documents are incorporated into these Terms by reference.
If these Terms conflict with a more specific written agreement concerning a particular Service, the more specific agreement controls for that Service.
For matters specifically involving Surge Now, Pay Later, the Surge Now, Pay Later Program Terms control over these general Terms.
4. Accounts and Authorized Users
You may be required to create an account and provide information such as:
- Your name;
- Business name;
- Email address;
- Phone number;
- Billing information;
- Business location;
- Professional membership information;
- Services offered; and
- Other information required to provide the Services.
You agree to keep all account information accurate, complete, and current.
You are responsible for:
- Protecting usernames and passwords;
- Controlling access to your account;
- All activity performed through your account;
- Charges incurred through your account;
- Actions taken by Authorized Users;
- Promptly removing access for former employees or contractors; and
- Notifying RV Surge of suspected unauthorized access.
You may not:
- Share login credentials with unauthorized individuals;
- Sell, transfer, sublicense, or rent access to your account;
- Access another customer’s account without permission;
- Use another person’s identity;
- Attempt to bypass security controls; or
- Use the Services to obtain unauthorized access to data or systems.
We may require password changes, multifactor authentication, identity verification, or other security measures.
5. Customer Responsibilities
You are responsible for operating your business and for all decisions made through or in connection with the Services.
You are solely responsible for:
- The services you provide to your customers;
- RV repairs and inspections;
- Diagnoses and recommendations;
- Workmanship;
- Pricing;
- Estimates and invoices;
- Service availability;
- Scheduling;
- Customer communication;
- Warranties;
- Refunds to your customers;
- Customer disputes;
- Employees and contractors;
- Business licensing;
- Certifications;
- Professional memberships;
- Insurance;
- Taxes;
- Permits;
- Safety procedures;
- Compliance with association rules; and
- Compliance with applicable laws.
RV Surge does not perform RV repairs or inspections for your customers.
RV Surge does not supervise your workmanship, employees, subcontractors, or customer relationships.
You remain responsible for independently reviewing information produced, stored, communicated, or recommended through the Services.
6. Fees and Payment
You agree to pay all fees described in your Order.
Fees may include:
- Setup fees;
- Onboarding fees;
- Monthly or annual subscription fees;
- Usage-based charges;
- Managed-service fees;
- Advertising-management fees;
- Custom-development fees;
- Website fees;
- Optional service fees;
- Third-party costs;
- Taxes; and
- Other approved charges.
Unless stated otherwise, recurring subscription fees are charged in advance.
Usage-based charges may be charged as they are incurred, periodically during the billing cycle, after the billing cycle, or through an account balance or automatic replenishment system.
You authorize RV Surge and its payment providers to charge the payment method on file for all amounts properly due under your account.
You agree to provide:
- Accurate billing information;
- A valid payment method;
- Current contact information; and
- Prompt notice of changes to billing information.
All prices are stated in United States dollars unless otherwise indicated.
7. Usage-Based Charges
Subscription fees do not necessarily include usage-based charges.
Usage charges may include activity associated with:
- Business phone numbers;
- Inbound and outbound calls;
- Call recording or transcription;
- Text messages;
- Multimedia messages;
- Email;
- Email verification;
- Artificial intelligence tools;
- Harvey Voice;
- Harvey Chat;
- Workflow premium actions;
- Data processing;
- Third-party integrations; and
- Other metered services.
Usage rates may include an RV Surge service or reseller margin.
You are responsible for usage generated by:
- You;
- Authorized Users;
- Employees;
- Contractors;
- Customers;
- Automations;
- Workflows;
- Campaigns;
- Artificial intelligence tools;
- Connected applications; and
- Unauthorized activity resulting from your failure to secure the account.
Third-party providers may change their underlying rates, rules, or billing structures.
RV Surge may update usage rates when reasonably necessary. Where practical, we will provide notice of material pricing changes.
We may establish:
- Usage limits;
- Spending limits;
- Account balances;
- Automatic replenishment;
- Deposits;
- Risk controls; or
- Temporary restrictions.
Failure to pay usage charges may result in immediate restriction of phone, email, SMS, AI, workflow, or other metered features.
8. Taxes
Fees do not include taxes unless expressly stated.
You are responsible for applicable:
- Sales taxes;
- Use taxes;
- Excise taxes;
- Communications taxes;
- Regulatory fees;
- Value-added taxes; and
- Other governmental charges.
RV Surge may collect and remit taxes where required.
You remain responsible for taxes relating to your own business, customers, employees, income, transactions, and services.
9. Failed Payments and Past-Due Accounts
If a payment fails, is declined, reversed, disputed, or remains unpaid, RV Surge may:
- Retry the payment;
- Contact you for updated billing information;
- Restrict usage;
- Suspend Services;
- Disable phone, email, SMS, AI, or payment features;
- Pause marketing or implementation work;
- Terminate your account;
- Recover collection expenses where permitted; and
- Require another payment method before restoring access.
You remain responsible for:
- Past-due balances;
- Usage incurred before suspension;
- Approved third-party charges;
- Chargeback fees;
- Collection expenses; and
- Other amounts properly due.
Suspension does not waive payment obligations.
10. No Refunds
All payments are final and nonrefundable except where a refund is expressly required by applicable law or specifically approved in a separate written agreement signed by RV Surge.
RV Surge does not provide:
- Prorated refunds;
- Refunds for unused time;
- Refunds for unused features;
- Refunds for missed sessions;
- Refunds for lack of account activity;
- Refunds for lack of business results;
- Refunds for failure to complete onboarding;
- Refunds for third-party charges;
- Refunds for advertising spend; or
- Refunds because you change your mind.
Cancellation affects eligible future recurring charges only.
It does not reverse charges already processed or amounts already earned or incurred.
Surge Now, Pay Later payments are also governed by the separate Surge Now, Pay Later Refund Policy.
11. Subscription Renewal and Cancellation
Recurring subscriptions automatically renew at the end of each billing period unless canceled before the next renewal date.
You may request cancellation through the process provided by RV Surge, which may include:
- Account settings;
- A cancellation form;
- Written notice; or
- Email to support@rvsurge.com.
A cancellation request must be received before the next renewal charge is processed to prevent the next renewal.
Requests received after a renewal charge has been processed will apply to the following renewal period.
Unless otherwise stated:
- Cancellation becomes effective at the end of the current paid billing period;
- No prorated refund will be issued;
- Usage charges and other outstanding amounts remain due;
- You remain responsible for activity occurring before access ends; and
- Add-on services may require separate cancellation.
The cancellation of one Service does not automatically cancel all other Services.
You are responsible for confirming which Services have been canceled.
12. Changes to Pricing or Plans
RV Surge may modify:
- Plan features;
- Subscription prices;
- Usage rates;
- Add-on pricing;
- Service limits; and
- Available features.
Changes to recurring subscription prices generally apply at a future renewal date after reasonable notice.
Changes resulting from third-party provider pricing, carrier charges, taxes, legal requirements, or usage-based costs may take effect sooner when reasonably necessary.
Your continued use of a paid Service after a pricing change becomes effective constitutes acceptance of the new pricing.
You may cancel before the new recurring price takes effect.
13. Service Modifications and Availability
RV Surge may add, modify, replace, limit, suspend, or discontinue features.
We may make changes because of:
- Product improvements;
- Security concerns;
- Legal requirements;
- Third-party provider changes;
- Carrier requirements;
- Platform changes;
- Technical limitations;
- Low usage;
- Abuse prevention; or
- Business or operational needs.
Your purchase is not contingent on:
- A future feature;
- A future integration;
- A future release;
- A public roadmap;
- A future artificial intelligence capability; or
- The continued availability of a particular third-party service.
RV Surge does not guarantee uninterrupted, error-free, or permanently available Services.
Temporary interruptions may result from:
- Maintenance;
- Updates;
- Internet failures;
- Carrier outages;
- Third-party outages;
- Security events;
- Software defects;
- Governmental actions;
- Natural disasters; or
- Other circumstances outside our reasonable control.
14. Websites, Domains, and Digital Assets
If RV Surge provides website, landing-page, domain, hosting, or digital-asset services, ownership and transfer rights depend on the applicable Order.
You are responsible for ensuring that all business information supplied for publication is accurate.
This includes:
- Business name;
- Address;
- Phone number;
- Service areas;
- Services;
- Pricing;
- Certifications;
- Memberships;
- Policies;
- Hours;
- Photographs;
- Logos;
- Customer claims; and
- Legal disclosures.
You are responsible for reviewing and approving content before publication.
Domain ownership depends on:
- Who registered the domain;
- Whose name appears in the registration;
- Who paid for the domain;
- The applicable Order; and
- The registrar’s rules.
A domain, website, file, integration, or digital asset may not be transferable while the account has an unpaid balance.
Transfer assistance may require payment of an administrative or technical fee.
RV Surge does not guarantee that a particular domain name will remain available.
15. Business Phone Numbers and Communications Services
Business phone numbers, calling, and messaging services depend on third-party carriers and providers.
RV Surge does not guarantee:
- Approval of a telephone number;
- Number portability;
- Carrier registration;
- Messaging registration;
- Message delivery;
- Call quality;
- Caller-ID display;
- Email deliverability;
- Continued availability of a number; or
- Acceptance of a communications campaign.
You are responsible for providing accurate information for telephone and messaging registrations.
You may not use communications features for:
- Fraud;
- Harassment;
- Threats;
- Deception;
- Unlawful solicitation;
- Illegal robocalling;
- Unlawful text messaging;
- Spoofing;
- Phishing;
- Purchased lists without appropriate rights;
- Messaging without required consent; or
- Any activity prohibited by law or carrier rules.
RV Surge may suspend communications features immediately if required by a carrier, provider, regulator, court, or applicable policy.
16. Email, SMS, and Marketing Compliance
You are solely responsible for ensuring that communications sent through your account comply with applicable laws, regulations, carrier requirements, platform rules, and industry standards.
You agree to:
- Contact only recipients you may lawfully contact;
- Obtain required consent;
- Maintain evidence of consent;
- Use accurate sender information;
- Avoid deceptive subject lines or claims;
- Provide legally required identification and disclosures;
- Include required unsubscribe or opt-out methods;
- Honor STOP and unsubscribe requests;
- Maintain suppression lists;
- Avoid purchased, scraped, harvested, or unlawfully obtained contact lists;
- Comply with quiet hours and calling restrictions;
- Follow telephone-carrier requirements; and
- Follow the RV Surge Anti-Spam Policy.
You remain responsible even if:
- RV Surge provides a template;
- An employee sends the message;
- A contractor manages the campaign;
- An automation sends the message;
- Artificial intelligence generates the message; or
- A third party assists with the campaign.
RV Surge may review, pause, reject, or terminate campaigns that appear unlawful, deceptive, abusive, or harmful to the platform or its providers.
17. Artificial Intelligence Features
The Services may include artificial intelligence tools such as:
- Harvey Voice;
- Harvey Chat;
- AI assistants;
- Content-generation tools;
- Workflow AI;
- Email-writing tools;
- Website-generation tools;
- Image-generation tools;
- Call transcription;
- Conversation summaries; and
- Other automated systems.
Artificial intelligence output may be:
- Inaccurate;
- Incomplete;
- Outdated;
- Misleading;
- Inappropriate;
- Repetitive; or
- Unsuitable for a particular situation.
You are responsible for:
- Testing AI tools;
- Reviewing their configuration;
- Monitoring output;
- Correcting errors;
- Training Authorized Users;
- Reviewing customer-facing messages;
- Providing appropriate human oversight; and
- Deciding whether output is suitable for use.
Artificial intelligence does not replace qualified professional judgment.
You must not rely exclusively on AI output for:
- Emergency instructions;
- RV diagnoses;
- Safety decisions;
- Legal advice;
- Tax advice;
- Accounting advice;
- Insurance advice;
- Warranty decisions;
- Binding pricing;
- Guaranteed scheduling;
- Technical repair instructions; or
- Other high-risk decisions.
You are responsible for configuring AI tools so they do not make unauthorized promises or representations.
AI services may depend on third-party providers whose models, availability, pricing, policies, and performance may change.
18. Call Recording, Transcription, and Monitoring
Some Services may record, transcribe, summarize, or analyze calls and conversations.
You are solely responsible for:
- Determining whether recording is permitted;
- Providing legally required notices;
- Obtaining legally required consent;
- Configuring announcements;
- Training employees;
- Protecting recordings and transcripts;
- Responding to customer requests; and
- Complying with applicable privacy and recording laws.
You may not use recording or monitoring features unlawfully.
RV Surge does not provide legal advice regarding recording consent requirements.
19. Payments Between You and Your Customers
RV Surge may provide tools that help you:
- Create estimates;
- Send invoices;
- Collect deposits;
- Accept payments;
- Store payment-related information; or
- Connect with a payment processor.
RV Surge is not:
- A bank;
- A lender;
- Your customer’s merchant;
- The seller of your RV services;
- A guarantor of payment; or
- Responsible for your customer’s transaction.
Payment processing may be provided by third parties.
You are responsible for:
- Pricing;
- Customer authorization;
- Services sold;
- Taxes;
- Refunds;
- Disputes;
- Chargebacks;
- Receipts;
- Warranties;
- Fulfillment;
- Customer complaints; and
- Compliance with processor rules.
RV Surge is not responsible for processor:
- Holds;
- Reserves;
- Delayed payouts;
- Restrictions;
- Account closures;
- Verification requests;
- Chargebacks; or
- Funding decisions.
20. Customer Data
As between you and RV Surge, you retain ownership of Customer Data you lawfully submit to the Services.
You grant RV Surge and its service providers a limited, nonexclusive right to:
- Host;
- Store;
- Process;
- Transmit;
- Display;
- Back up;
- Modify as technically necessary; and
- Otherwise use Customer Data
to provide, maintain, secure, support, and improve the Services.
You represent that:
- You have the right to provide the Customer Data;
- Your use of Customer Data is lawful;
- Customer Data does not infringe third-party rights;
- You have obtained necessary permissions and consents; and
- Instructions you provide to RV Surge are lawful.
You are responsible for the accuracy, quality, legality, and origin of Customer Data.
21. Data Retention and Account Closure
You are responsible for exporting or preserving data you wish to retain before your account closes.
Following suspension, cancellation, or termination:
- Access may be restricted or disabled;
- Features may stop functioning;
- Automations may stop;
- Phone or messaging services may be disconnected;
- Integrations may stop;
- Data may become unavailable; and
- Data may later be deleted according to our retention practices and third-party provider requirements.
RV Surge does not guarantee indefinite storage of Customer Data after termination.
Where available, data exports may be limited by:
- The plan;
- The data format;
- Technical capabilities;
- Third-party restrictions;
- Legal requirements; and
- Payment status.
RV Surge may retain data where reasonably necessary for:
- Legal compliance;
- Security;
- Fraud prevention;
- Billing;
- Dispute resolution;
- Backups; or
- Enforcement of agreements.
22. Privacy and Security
Our collection and use of personal information are described in the RV Surge Privacy Policy.
You agree to maintain appropriate privacy policies and disclosures for your own business.
When you collect customer information through the Services, you are responsible for:
- Providing an appropriate privacy notice;
- Explaining your use of customer information;
- Obtaining required consent;
- Securing customer information;
- Limiting employee access;
- Responding to privacy requests;
- Complying with applicable privacy laws; and
- Notifying appropriate parties of incidents where required.
RV Surge uses reasonable administrative, technical, and organizational safeguards, but no system is completely secure.
You must notify RV Surge promptly if you suspect:
- Unauthorized access;
- Account compromise;
- Data loss;
- Fraud;
- Security vulnerabilities; or
- Misuse of the Services.
23. RV Surge Intellectual Property
RV Surge and its licensors retain all rights in:
- The Services;
- Software;
- Platform configuration;
- Templates;
- Workflows;
- Automations;
- Prompts;
- Processes;
- Training materials;
- Launch guides;
- Trackers;
- Checklists;
- Videos;
- Webinar recordings;
- Designs;
- Graphics;
- Written content;
- Reports;
- Documentation;
- Branding;
- Trademarks; and
- Other proprietary materials.
This includes RV Surge-created materials made available through:
- RV Surge Essentials;
- Surge Now, Pay Later;
- Communities;
- Onboarding;
- Office Hours;
- Webinars;
- Courses;
- Client accounts; and
- Educational resources.
You receive a limited, revocable, nonexclusive, nontransferable license to use these materials for your own enrolled business and only while authorized.
You may not:
- Resell them;
- Republish them;
- Distribute them;
- Share them with competitors;
- Copy them for another business;
- Remove branding;
- Create competing products from them;
- Reverse engineer the Services;
- Decompile software;
- Circumvent access controls;
- Sell account access; or
- Use RV Surge materials outside the permitted scope.
No ownership rights are transferred to you except where expressly stated in writing.
24. Customer Materials and Branding
You retain ownership of original materials you provide, including:
- Your logo;
- Business photographs;
- Original written content;
- Business name;
- Customer lists;
- Product or service information; and
- Other Customer-created materials.
You grant RV Surge permission to use those materials as reasonably necessary to provide the Services.
You represent that you have the right to use all materials you provide.
You are responsible for claims involving:
- Copyright infringement;
- Trademark infringement;
- Rights of publicity;
- Customer photographs;
- Stock images;
- Licensed content;
- Reviews;
- Testimonials; and
- Other third-party materials you provide.
25. Feedback and Suggestions
You may voluntarily provide suggestions, ideas, comments, or feedback.
Unless otherwise agreed in writing, feedback is not confidential.
You grant RV Surge a perpetual, worldwide, nonexclusive, royalty-free right to use feedback to improve, develop, market, and operate its products and services.
RV Surge is not required to:
- Use the feedback;
- Compensate you;
- Credit you;
- Keep it confidential; or
- Develop a requested feature.
This section does not transfer ownership of your Customer Data or confidential business records.
26. Community, Training, and Events
RV Surge may provide access to:
- Private communities;
- Group onboarding;
- Office Hours;
- Webinars;
- Courses;
- Training sessions;
- Educational events;
- Discussion groups; and
- Peer networking.
You agree to interact professionally.
You may not:
- Harass others;
- Threaten others;
- Post unlawful content;
- Share private member information;
- Spam members;
- Solicit members without permission;
- Upload malicious files;
- Record sessions without permission;
- Redistribute recordings;
- Resell training;
- Impersonate another person; or
- Disrupt the community.
RV Surge may moderate, edit, remove, or restrict community content and access.
Community access may be suspended or terminated for violations without refund.
27. Recordings and Participant Content
RV Surge may record onboarding, Office Hours, webinars, and educational sessions.
By participating, you understand that your:
- Name;
- Voice;
- Video;
- Profile image;
- Chat comments;
- Questions; or
- Screen content
may appear in a recording.
Where practical, RV Surge may provide notice that a session is being recorded.
You should avoid sharing sensitive, confidential, or customer-identifying information during group sessions.
RV Surge may use recordings to:
- Provide replays;
- Train Participants;
- Improve the Program;
- Maintain educational libraries; and
- Document questions and answers.
RV Surge will not intentionally use a Participant’s personal story as a paid advertisement or testimonial without appropriate permission.
28. CEU and Professional Education
Some educational events may be identified as potentially eligible for continuing education credit.
RV Surge does not guarantee that:
- Every event qualifies;
- Every professional organization will accept the credit;
- A Participant will pass the required quiz;
- A late submission will be accepted; or
- An association will maintain the same requirements.
Participants are responsible for:
- Attending or viewing required content;
- Completing quizzes;
- Meeting deadlines;
- Achieving the required score;
- Maintaining professional membership; and
- Confirming acceptance with the applicable organization.
Professional associations independently determine whether to award or accept continuing education credit.
29. Professional Associations and Independent Organizations
NRVTA, RVTAA, NRVIA, RVTI, RV Help, and other industry organizations are independent from RV Surge unless expressly stated otherwise in a written announcement approved by the applicable organization.
Unless expressly stated:
- They do not own RV Surge;
- They do not operate RV Surge;
- They do not finance Surge Now, Pay Later;
- They do not guarantee the Program;
- They do not guarantee results;
- They are not responsible for RV Surge Services; and
- Their names do not constitute an endorsement.
Membership verification does not create a partnership, agency, joint venture, franchise, or fiduciary relationship.
30. Third-Party Services
The Services may depend on or integrate with third-party providers, including:
- Telephone carriers;
- Email providers;
- Payment processors;
- Domain registrars;
- Hosting providers;
- Advertising platforms;
- Search engines;
- Social-media platforms;
- Mapping providers;
- Artificial intelligence providers;
- Integration partners; and
- Software providers.
RV Surge does not control third-party:
- Availability;
- Pricing;
- Policies;
- Approvals;
- Verification;
- Outages;
- Restrictions;
- Account decisions;
- Search rankings;
- Ad approvals;
- Deliverability;
- Data practices; or
- Feature changes.
Your use of a third-party service may be subject to the third party’s terms and privacy policy.
RV Surge is not responsible for third-party actions, omissions, interruptions, or account decisions.
31. Advertising and Marketing Services
RV Surge may provide advertising tools, education, templates, recommendations, managed campaigns, or other marketing services.
Advertising spend is separate from RV Surge fees unless expressly stated otherwise.
You are responsible for approving:
- Budgets;
- Offers;
- Service areas;
- Claims;
- Pricing;
- Promotions;
- Creative materials;
- Targeting;
- Business information; and
- Landing-page content.
RV Surge does not guarantee:
- Ad approval;
- Leads;
- Call volume;
- Cost per lead;
- Conversion rate;
- Revenue;

- Business success;
- Business launch;
- Search rankings;
- Reviews;
- Advertising performance;
- Platform savings;
- Customer response;
- Specific launch dates; or
- Specific financial outcomes.
Results depend on factors outside RV Surge’s control, including:
- Market conditions;
- Location;
- Competition;
- Seasonality;
- Pricing;
- Service demand;
- Skill;
- Certification;
- Reputation;
- Availability;
- Lead response;
- Marketing budget;
- Customer service;
- Business capacity;
- Work quality; and
- Your implementation and effort.
Examples, illustrations, projections, case studies, and success stories are not guarantees of future results.

RV Surge is not:

- An accounting firm;
- A tax adviser;
- An insurance agency;
- A bank;
- A government licensing authority;
- An RV-certification organization; or
- A substitute for a qualified RV professional.
Information provided through the Services is educational and general in nature.
You should consult qualified professionals regarding:
- Legal matters;
- Taxes;
- Accounting;
- Insurance;
- Licensing;
- Business formation;
- Contracts;
- Employment;
- Safety;
- Technical RV work; and
- Regulatory compliance.
35. Acceptable Use
You may not use the Sites or Services to:
- Violate any law;
- Infringe intellectual-property rights;
- Invade privacy;
- Harass or threaten others;
- Distribute malware;
- Conduct fraud;
- Misrepresent identity;
- Send unlawful communications;
- Scrape data without authorization;
- Access systems without permission;
- Circumvent security;
- Interfere with platform operations;
- Resell unauthorized access;
- Create deceptive reviews;

- Misrepresent an affiliation; or
- Damage the reputation or operation of the Services.
RV Surge may investigate suspected misuse and cooperate with lawful investigations or court orders.
36. Suspension and Termination by RV Surge
RV Surge may suspend, restrict, or terminate access when reasonably necessary because of:
- Nonpayment;
- Fraud;
- Chargebacks;
- Security risks;
- Illegal activity;
- Carrier complaints;
- Spam complaints;
- Platform abuse;
- Misrepresentation;
- Account compromise;
- Harassment;
- Violation of these Terms;
- Violation of additional policies;
- Third-party provider requirements;
- Regulatory requirements; or
- Risk to RV Surge, its providers, or other users.
RV Surge may act without advance notice when immediate action is reasonably necessary.
Termination does not eliminate:
- Outstanding balances;
- Usage charges;
- Third-party charges;
- Indemnification obligations;
- Confidentiality obligations;
- Intellectual-property protections; or
- Other provisions intended to survive termination.
37. Confidential Information
Each party may receive nonpublic information from the other.
Confidential information may include:
- Business plans;
- Pricing;
- Customer lists;
- Technical information;
- Credentials;
- Workflows;
- Internal documents;
- Financial information; and
- Nonpublic strategies.
The receiving party agrees to:
- Use confidential information only for the intended relationship;
- Protect it using reasonable care; and
- Limit access to those who reasonably need it.
Confidential information does not include information that:
- Is publicly available without breach;
- Was already lawfully known;
- Is independently developed;
- Is lawfully received from a third party; or
- Must be disclosed by law.
38. Disclaimer of Warranties
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SITES, SERVICES, SOFTWARE, CONTENT, TRAINING, ARTIFICIAL INTELLIGENCE FEATURES, TEMPLATES, AND MATERIALS ARE PROVIDED “AS IS” AND “AS AVAILABLE.”
RV SURGE DISCLAIMS ALL EXPRESS, IMPLIED, AND STATUTORY WARRANTIES, INCLUDING WARRANTIES OF:
- MERCHANTABILITY;
- FITNESS FOR A PARTICULAR PURPOSE;
- TITLE;
- NON-INFRINGEMENT;
- ACCURACY;
- RELIABILITY;
- AVAILABILITY;
- SECURITY; AND
- RESULTS.
RV Surge does not warrant that:
- The Services will meet every requirement;
- The Services will be uninterrupted;
- The Services will be error-free;
- Every defect will be corrected;
- Data will never be lost;
- Every message will be delivered;
- Every integration will continue working;
- AI output will be accurate; or
- The Services will produce a business result.
Some jurisdictions do not allow certain warranty exclusions. In those jurisdictions, exclusions apply only to the extent permitted by law.
39. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, RV SURGE, LOCAL LEAD HUB LLC, AND THEIR OWNERS, OFFICERS, DIRECTORS, EMPLOYEES, CONTRACTORS, AFFILIATES, LICENSORS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR:
- INDIRECT DAMAGES;
- INCIDENTAL DAMAGES;
- SPECIAL DAMAGES;
- CONSEQUENTIAL DAMAGES;
- EXEMPLARY DAMAGES;
- PUNITIVE DAMAGES;
- LOST PROFITS;
- LOST REVENUE;
- LOST BUSINESS;
- LOST OPPORTUNITIES;
- LOST DATA;
- BUSINESS INTERRUPTION;
- REPUTATIONAL HARM; OR
- COSTS OF SUBSTITUTE SERVICES.
This limitation applies regardless of:
- The legal theory;
- Whether damages were foreseeable;
- Whether RV Surge was advised of the possibility; or
- Whether a limited remedy fails of its essential purpose.
To the maximum extent permitted by law, the total collective liability of RV Surge and Local Lead Hub LLC arising from or related to the Services will not exceed the greater of:
- One hundred dollars; or
- The fees you paid directly to RV Surge for the affected Service during the three months immediately preceding the event giving rise to the claim.
These limitations do not apply where liability cannot legally be limited.
40. Indemnification
You agree to defend, indemnify, and hold harmless Local Lead Hub LLC, RV Surge, and their owners, officers, directors, employees, contractors, affiliates, licensors, and service providers from claims, damages, liabilities, judgments, losses, costs, and reasonable attorneys’ fees arising out of or related to:
- Your breach of these Terms;
- Your use or misuse of the Services;
- Your Customer Data;
- Your customer communications;
- Your advertising or marketing;
- Your products or services;
- Your RV repairs or inspections;
- Your employees or contractors;
- Your violation of law;
- Your failure to obtain consent;
- Your infringement of third-party rights;
- Your customer disputes;
- Your payment disputes;
- Your taxes;
- Your negligence;
- Your willful misconduct; or
- The conduct of an Authorized User.
RV Surge may select counsel and control the defense of a covered claim, provided that you will not be required to settle a claim admitting wrongdoing by you without your consent.
41. Electronic Communications and Acceptance
You consent to receive electronic:
- Agreements;
- Notices;
- Disclosures;
- Invoices;
- Receipts;
- Account updates;
- Policy changes; and
- Other business communications.
Electronic records satisfy requirements that a communication be in writing to the extent permitted by law.
Your electronic acceptance may be shown through:
- A checked box;
- An electronic signature;
- Account creation;
- Submission of a form;
- Payment;
- Continued use after notice; or
- Other electronic action demonstrating agreement.
You are responsible for maintaining an email address capable of receiving notices.
You may save or print these Terms for your records.
42. Changes to These Terms
RV Surge may update these Terms.
When changes are material, we may provide notice through:
- Email;
- The account;
- The Site;
- A banner;
- A notification; or
- Another reasonable method.
Changes generally apply prospectively from the stated effective date.
Your continued use of the Services after an updated version becomes effective constitutes acceptance of the updated Terms.
If you do not agree to an updated version, you must stop using the Services and cancel eligible recurring Services before the next renewal.
43. Governing Law
These Terms and any dispute arising out of or relating to them are governed by the laws of the State of Texas, without regard to conflict-of-law principles.
The United Nations Convention on Contracts for the International Sale of Goods does not apply.
44. Exclusive Venue and Jurisdiction
Any lawsuit or legal proceeding arising out of or relating to these Terms or the Services must be brought exclusively in:
- A state court located in Travis County, Texas; or
- The United States District Court for the Western District of Texas, Austin Division,
provided that the court has subject-matter jurisdiction.
Each party consents to the personal jurisdiction of those courts and waives objections based on venue or inconvenient forum.
Nothing in this section prevents RV Surge from seeking temporary or injunctive relief in another jurisdiction to protect confidential information, intellectual property, security, or account access.
45. Informal Dispute Resolution
Before filing a lawsuit, the complaining party must provide written notice describing:
- The nature of the dispute;
- Relevant facts;
- The requested resolution; and
- Contact information.
The parties will attempt in good faith to resolve the dispute informally for at least thirty days after notice is received.
This requirement does not prevent a party from seeking urgent injunctive or emergency relief.
46. Force Majeure
RV Surge is not liable for delay or failure caused by circumstances beyond its reasonable control, including:
- Natural disasters;
- Severe weather;
- Fire;
- War;
- Terrorism;
- Civil unrest;
- Labor disputes;
- Internet failures;
- Carrier failures;
- Utility failures;
- Cyberattacks;
- Government actions;
- Regulatory changes;
- Third-party outages;
- Epidemics;
- Pandemics; or
- Other events beyond reasonable control.
Payment obligations for Services already provided are not excused by this section.
47. Assignment
You may not assign or transfer these Terms, your account, or your rights without prior written approval from RV Surge.
RV Surge may assign these Terms in connection with:
- A merger;
- Acquisition;
- Reorganization;
- Sale of assets;
- Financing;
- Affiliate transfer; or
- Transfer of the Services.
Any prohibited assignment is void.
48. Independent Parties
You and RV Surge are independent contracting parties.
Nothing in these Terms creates:
- Employment;
- Partnership;
- Joint venture;
- Agency;
- Franchise;
- Fiduciary relationship;
- Exclusive relationship; or
- Guaranteed referral arrangement.
Neither party may bind the other except as expressly authorized in writing.
49. No Third-Party Beneficiaries
These Terms benefit only you and RV Surge unless expressly stated otherwise.
No other person or entity has the right to enforce these Terms.
50. Severability
If a provision of these Terms is held unlawful, invalid, or unenforceable, that provision will be modified to the minimum extent necessary or severed.
The remaining provisions will remain in effect.
51. No Waiver
Failure to enforce a provision does not waive that provision or any other right.
A waiver is effective only if provided in writing by an authorized representative.
52. Headings
Section headings are for convenience only and do not affect interpretation.
53. Entire Agreement
These Terms, together with:
- Your Order;
- The Privacy Policy;
- The Anti-Spam Policy;
- The Refund Policy;
- Applicable Program Terms;
- Applicable service agreements; and
- Other incorporated written terms
constitute the complete agreement concerning the Services.
They supersede prior oral or written discussions concerning the same subject matter.
Sales conversations, demonstrations, webinars, presentations, and informal messages do not modify these Terms unless included in a written agreement authorized by RV Surge.
54. Survival
Provisions concerning the following survive cancellation or termination:
- Payment obligations;
- Customer responsibility;
- Confidentiality;
- Intellectual property;
- Data rights;
- Disclaimers;
- Limitations of liability;
- Indemnification;
- Governing law;
- Venue;
- Dispute resolution; and
- Provisions that by their nature should survive.

- Any signed or electronically accepted Order or enrollment agreement.
If a more specific policy conflicts with these Terms regarding a specific program or transaction, the more specific policy controls for that subject.
57. Acknowledgment
By accessing the Sites, creating an account, checking an acceptance box, electronically signing an agreement, submitting payment, or using the Services, you acknowledge that:
- You have read these Terms;
- You understand these Terms;
- You have had an opportunity to save or print them;
- You agree to be bound by them;
- You have authority to enter into this agreement; and
- You agree to the incorporated policies applicable to your Services.
